Welcome to Foodie ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our food delivery platform and mobile application. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the service.

2. Description of Services

Foodie is a comprehensive food delivery platform that connects:

  • Customers who wish to order food and groceries
  • Restaurants and Grocery Shops that offer food preparation and delivery services
  • Delivery Partners who provide logistics and delivery services
  • Service Providers including catering and event management services

We facilitate transactions between these parties but are not directly responsible for the preparation, quality, or delivery of food items.

3. User Registration and Accounts

Registration Requirements

  • Users must provide accurate and complete information during registration
  • Valid phone number and email address are required
  • Users must be at least 18 years old to create an account
  • Business users must provide valid business documentation

Account Security

  • Users are responsible for maintaining password confidentiality
  • Users must notify us immediately of any unauthorized access
  • We reserve the right to suspend accounts showing suspicious activity
  • Users are responsible for all activities under their account

4. User Responsibilities

For Customers

  • Provide accurate delivery information and location
  • Be available during estimated delivery times
  • Make timely payments for Cash on Delivery orders
  • Treat delivery partners with respect and courtesy
  • Report any issues with orders promptly

For Restaurants and Grocery Shops

  • Provide accurate menu information and pricing
  • Maintain food safety and hygiene standards
  • Prepare orders within specified timeframes
  • Update availability status in real-time
  • Comply with local health and safety regulations

For Delivery Partners

  • Deliver orders safely and within estimated times
  • Maintain vehicle and equipment in good condition
  • Follow hygiene protocols and safety guidelines
  • Communicate professionally with customers
  • Update order status accurately

5. Order Process and Payment

Order Placement

  • Orders are subject to restaurant/shop availability and confirmation
  • Prices may change without prior notice
  • Minimum order values may apply for certain areas
  • Delivery charges are calculated based on distance and other factors

Payment Methods

  • Online Payment: Credit/Debit cards, UPI, wallets via Razorpay
  • Cash on Delivery (COD): Available in select areas
  • QR Code Payments: UPI-based instant payments
  • All online payments are processed securely through our payment partners

6. Pricing and Fees

  • Product prices are set by individual restaurants and shops
  • Service fees and delivery charges may apply
  • Taxes are included in the final price as applicable
  • Dynamic pricing may apply during peak hours
  • Promotional offers are subject to specific terms and conditions
  • All prices are displayed in Indian Rupees (INR)

7. Prohibited Activities

Users are prohibited from:

  • Using the platform for illegal or unauthorized purposes
  • Providing false or misleading information
  • Attempting to gain unauthorized access to the platform
  • Interfering with the platform's operation or security
  • Violating any applicable laws or regulations
  • Harassing or abusing other users or staff
  • Creating fake accounts or impersonating others
  • Reverse engineering or copying our technology

8. Intellectual Property Rights

  • All platform content, trademarks, and logos are owned by Foodie
  • Users may not reproduce, distribute, or create derivative works
  • Restaurant and product images are owned by respective businesses
  • User-generated content remains the property of the user but grants us usage rights
  • We respect intellectual property rights and expect users to do the same

9. Limitation of Liability

Foodie's liability is limited as follows:

  • We are not responsible for food quality, preparation, or safety
  • We are not liable for delays caused by restaurants or delivery partners
  • Our maximum liability is limited to the order value
  • We are not responsible for third-party payment processing issues
  • Force majeure events (natural disasters, strikes, etc.) exempt us from liability
  • We provide the platform "as is" without warranties

10. Privacy and Data Protection

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which includes:

  • Collection and use of personal information
  • Data sharing with restaurants and delivery partners
  • Security measures for data protection
  • User rights regarding personal data
  • Cookie usage and tracking technologies

11. Account Suspension and Termination

Grounds for Suspension

  • Violation of these Terms and Conditions
  • Fraudulent or suspicious activity
  • Repeated order cancellations or COD violations
  • Abusive behavior towards staff or delivery partners
  • Non-payment of outstanding dues

Termination Process

  • We may suspend or terminate accounts with or without notice
  • Users may terminate their accounts at any time
  • Upon termination, all user rights cease immediately
  • Outstanding payments remain due after termination

12. Dispute Resolution

In case of disputes:

  • Users should first contact our customer support team
  • We aim to resolve disputes amicably and promptly
  • Unresolved disputes will be subject to arbitration
  • Indian law governs these terms and any disputes
  • Courts in Bhubaneswar, Odisha have exclusive jurisdiction

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated through:

  • In-app notifications
  • Email notifications to registered users
  • Updates posted on our website
  • Social media announcements for major changes

Continued use of our services after changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Bhubaneswar, Odisha.
